The People’s Democratic Party PDP and her Presidential Candidate Atiku Abubarka has withdrawn the fresh suit which they filed against INEC seeking to be granted permission to join in the inspection of the materials used in the February 25 presidential election.

Recall that Atiku Abubarka is challenging the election process which declared the presidential candidate of APC Asiwaju Bola Ahmed Tinubu as the winner of the election.

When the case was called up for hearing today at the federal high court in Abuja, Atiku Abubarka through his lead council, Joe Gadzama told the court that he has already filled a notice of discontinuance of the suit because it has been overtaken by events.

It has been widely speculated that the reason for the withdrawal of the suit maybe as a result of the meeting Atiku Abubarka and his legal team held on Monday after INEC had called them for a meeting.

Speaking to newsmen after the court proceedings Mr Joe Gadzama told newsmen that the decision to withdraw the suit was as a result of the assurance given to them by the independent national electoral commission INEC to grant their agents access to observe the inspection process of election materials they requested for most especially the ballot papers.

According to him, since they have agreed with INEC, the case which was brought to court in their fresh application, they felt it was not necessary to continue with the case since it has already been sorted out.which prompted them to filed a discontinuance application which was granted to them by the court.

Following the successful withdrawal of the suit the three man member panel led by justice Joseph Ikyegh struck it out.
